These Terms & Conditions ("Terms") govern your use of bostonsquash.com (the "Site"), operated by Boston Squash ("Boston Squash," "we," "us," or "our"), and any lessons, camps, clinics, or merchandise you book or purchase through it.
By using the Site, booking a lesson or clinic, or placing an order, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site or our services.
You agree to use the Site only for lawful purposes and in a way that doesn't infringe the rights of, or restrict or inhibit the use of, the Site by anyone else. You agree not to attempt to gain unauthorized access to any part of the Site, its underlying systems, or the data of other users.
Information on the Site about our lessons, camps, and clinics (including schedules, pricing, ages, and locations) is provided for general informational purposes and is subject to change. Booking a lesson, camp, or clinic through our contact/booking form does not guarantee a spot until confirmed by us directly. Specific policies for cancellations, makeups, or scheduling changes for a given program will be communicated to you when you book.
When you place an order through our shop, you're making an offer to purchase the item(s) in your cart at the listed price, which we may accept or decline (for example, if an item turns out to be out of stock). We'll do our best to keep product availability accurate, but we don't guarantee that every item shown is in stock at the moment you order — see Section 7 for what happens if an item you ordered isn't available.
Product images and descriptions are provided as accurately as possible, but actual color, print placement, and material may vary slightly from what's shown on screen.
All purchases on the Site are processed securely through PayPal. We do not collect or store your payment card or bank details ourselves. By placing an order, you authorize the applicable charge for your order total (including shipping) through PayPal. Prices are listed in U.S. dollars.
We ship to addresses within the United States and internationally, at the shipping rate shown at checkout based on your destination country. Orders typically ship within 3–5 business days of purchase. Delivery timeframes after shipping depend on your location and are estimates, not guarantees. Risk of loss and title for items you purchase pass to you upon our delivery to the shipping carrier.
You're responsible for providing an accurate shipping address at checkout. We're not responsible for orders delayed or lost due to an incorrect or incomplete address provided by you.
We handle returns, exchanges, and order issues (such as a defective item, the wrong item shipped, or an item that arrives damaged) on a case-by-case basis — we want you to be happy with your order. If something's wrong with your order, contact us using the details in Section 13 and we'll work with you to make it right.
If an item in your order turns out to be unavailable after you've placed your order, we'll contact you and either refund that item or offer a substitute — we won't ship a substitute without checking with you first.
All content on the Site — including the Boston Squash name and logo, text, graphics, photos, and design — is owned by Boston Squash or used with permission, and is protected by applicable intellectual property laws. You may not copy, reproduce, or use our branding or content without our prior written permission, except for your own personal, non-commercial use of the Site.
The Site and its content are provided "as is" without warranties of any kind, express or implied. While we work to keep information on the Site accurate and up to date, we don't guarantee that it is complete, current, or error-free.
To the fullest extent permitted by law, Boston Squash and its owner/operator will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or our services. Our total liability for any claim relating to a merchandise order will not exceed the amount you paid for that order.
Nothing in these Terms limits any liability that cannot legally be limited, including liability for gross negligence or willful misconduct.
Squash and related physical training carry an inherent risk of injury. By participating in Boston Squash lessons, camps, or clinics, you (or, for minors, your parent/guardian) acknowledge and accept these risks. Specific waivers or liability releases may be provided separately at the time of registration for a given program.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles, regardless of your location.
We may update these Terms from time to time, for example as our shop or services change. We'll update the "Last updated" date at the top of this page when we do. Continued use of the Site after changes are posted means you accept the updated Terms.
